Cooperative Negotiation
Not every couple can divorce using mediation or the collaborative approach. When that is the case, I may serve as a consulting attorney for one party in negotiations directly with the other spouse/partner or another attorney. Whether I am acting as an impartial mediator or as a consulting attorney, I first help my clients clarify what is most important to them in moving forward with life after separation. This prioritization informs their choices concerning important decision points. Next, I work to understand the needs behind the other spouse's or partner's positions so that settlement is more likely. In cooperative negotiation, I continue to work with my client to balance the costs and benefits at each step of the process. I want the client to understand what they are agreeing to and why.
